Ryde Harbour Terms and Conditions

Ryde Harbour is a drying harbour.
Persons and vessels using Ryde Harbour do so entirely at their own risk.
The Isle of Wight Council shall not be liable for any loss or damage suffered or sustained by such vessels or goods aboard them or by the owners or persons interested in such vessels or goods howsoever caused.
The Isle of Wight Council shall not be liable for any personal injury, including fatal injury of the master or
any member of the crew or any passenger of such vessels or any persons visiting such vessels
sustained aboard such vessels or while embarking upon or disembarking from such vessels or while
upon any premises owned by or leased to the Isle of Wight Council howsoever caused.
The Isle of Wight Council reserves the right to move any vessel, gear, equipment or other goods at any
time for reasons of safety, security or good management of the Harbour and premises.
The Harbourmasters have the absolute discretion to refuse any users for whatever reason at any time.
Ryde Harbour does not have facilities for working and registered fishing boats or vessels on which the
owners/crew live permanently.
Berth holders away from the Harbour are to inform the Harbourmasters of their cruising intentions. Harbour staff will use these berths for visitors when vessels are away.
The Harbourmasters are to be informed of any changes, either to the owner's details or a change of
ownership.
Berth allocations will be made on a first come, first served' basis according to the date of receipt of
application and the date from which a berth is required, subject to suitable berths being available.
Vessels allocated berths on 'A' pontoon can expect visiting vessels to berth on them during busy
periods.
Owners selling vessels will under normal circumstances not expect the new owner to take up
a berth in Ryde Harbour and the vessel must be removed and join the waiting list.
Owners upgrading their vessels will only be allocated a berth if there is a suitable one available and their previous boat has departed Ryde Harbour.
All boats in Ryde Harbour must be maintained in a good and seaworthy condition.
The Isle of Wight Council reserves the right to remove from the Harbour any boats in a poor condition.
Harbour fees are to be paid in advance at Harbour office in accordance with the conditions of payment.
Berth holders in arrears with Harbour dues will receive a written warning stating that, if Harbour dues
are not brought up to date. The Isle of Wight Council reserves the right to remove the boat from the
Harbour. This could immediately lead to the boat being sold to recover any outstanding dues. If fees
become in arrears an account will be raised which will incur an administrative charge for the first and
any subsequent account raised.
Vessels berthed in Ryde Harbour during the summer months must pay fees for a minimum period of six months.
All vessels using Council property must have public liability (third party) insurance with a minimum
indemnity of £2 million. To ensure compliance, all berth holders must send a copy of their current
insurance certificate to Ryde Harbour office with the application form. The copy will be held for
reference. Whenever the insurance is renewed or changed for any reason, a copy of the new certificate
must be sent to Ryde Harbour office. Failure to produce a current insurance certificate will mean the
application will be turned down and, where applicable, will lead to the boat being removed from Ryde
Harbour and costs charged to the vessel's owner. Berth holders will also be charged the daily rate as
set out in the fees and charges for their vessel when the insurance has lapsed and a new certificate is
not produced.
Boat engines are not to be run in gear while craft secured to pontoon.
Parking vehicles on the Esplanade and Harbour wall is prohibited. However, unloading/loading of heavy
stores may take place in the vicinity of the Harbour office, with prior permission of the Harbourmaster.
